Terms of Service

Effective date: 4 June 2026. These terms are an agreement between you and Business Solutions, LLC ("MyTalker", "we", "us") for use of the MyTalker app and website. Please read them. By using MyTalker, you accept these terms.

1. Who can use MyTalker

You may use MyTalker if you can form a binding agreement with us, or if a parent or guardian agrees to these terms on behalf of a minor or a person they support. Accounts for minors require verified parental or guardian consent. A parent, guardian, caregiver, or therapist may set up and manage MyTalker for someone in their care.

2. Important: a communication aid, not a medical device

MyTalker is an augmentative and alternative communication (AAC) and educational tool. It is not a medical device, and it does not provide medical, diagnostic, therapeutic, or emergency services. Predictions, transcriptions, and translations are produced by software and may be incomplete or wrong. Do not rely on MyTalker for emergencies or for any situation where an error could cause harm; always have an alternative way to call for help. Use of MyTalker does not create a clinical relationship and is not a substitute for professional advice from a speech-language pathologist or physician.

3. Your license to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use MyTalker for its intended purpose, subject to these terms and any app store rules. You may not copy, resell, reverse-engineer, or misuse the service except where the law permits.

4. Accounts and security

You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. We may suspend accounts to protect users or the service.

5. Acceptable use

Use MyTalker lawfully and respectfully. Do not use it to harass, harm, or impersonate others, to break the law, to interfere with the service, or to attempt unauthorized access. We may remove content or limit access for violations.

6. Subscriptions and payment (when offered)

Core features may be offered free. If we introduce paid features, the price, billing period, and what is included will be shown before you buy. Subscriptions purchased in the iOS app are processed and billed by Apple under its terms, and renew automatically unless you cancel at least 24 hours before the period ends; manage or cancel in your App Store account. Web subscriptions are billed by our payment processor. Where the law gives you a right of withdrawal or a refund (for example in the EU/EEA and UK), those rights apply. App store purchases are also subject to the store's refund policy.

7. Intellectual property and third-party content

MyTalker, its software, design, and branding belong to us or our licensors. Picture symbols are provided in part by the ARASAAC pictogram library, created by the Government of Aragón (Spain) and licensed under Creative Commons BY-NC-SA; their authorship is acknowledged and their license terms apply to those symbols. Map and place data are provided by Google. Some pictures are generated by AI on request.

8. Your content

Content you add (words, saved phrases, photos of your things and people) remains yours. You grant us only the limited permission needed to store, process, and display it to provide the service to you and, with your consent, to sync it across your devices. You are responsible for the content you add and for having the right to use any photos.

9. Third-party services

MyTalker relies on third parties (including Google, Anthropic, Apple, and a payment processor) to provide some features. Your use of those features may also be subject to those providers' terms. We are not responsible for third-party services we do not control.

10. Disclaimers

Except where the law does not allow it, MyTalker is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and accuracy. We do not warrant that predictions, transcriptions, or translations will be error-free or uninterrupted.

11. Limitation of liability

To the extent permitted by law, MyTalker and its operators will not be liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your mandatory consumer rights.

12. Termination

You may stop using MyTalker and delete your account at any time. We may suspend or end access if you breach these terms or to protect users or the service. You can export or delete your data as described in our Privacy Policy.

13. Governing law and disputes

These terms are governed by the laws of the jurisdiction in which Business Solutions, LLC is established, without affecting any mandatory consumer-protection rights you have in your country of residence. We will try to resolve disputes informally first; contact us at chad@solutions.co.

14. Apple App Store terms

If you obtained MyTalker from the Apple App Store, these terms are between you and us, not Apple, and Apple is not responsible for the app or its support. The standard Apple Licensed Application End User License Agreement also applies; where it conflicts with these terms, that agreement governs for App Store usage, and Apple is a third-party beneficiary entitled to enforce it.

15. Changes

We may update these terms as the product evolves. We will post the new effective date here and, for material changes, give notice in the app. Continued use after changes means you accept the updated terms.
